1. Sabse pehla step: SDM office ka environment samajhna (ignore mat karein)
Special Marriage Act ka procedure kagaz par chahe simple ho, ground par har SDM office ka apna culture hota hai.
Har SDM ek human hota hai:
- Agar nature cooperative ho → process smooth.
- Agar strict / religiously inclined ho → unnecessary objections aa sakti hain.
Isliye pehla practical step yeh hi hota hai ki:
1–2 SDM offices visit karke dekhein ki kahan aap comfortably SMA marriage kar sakte hain.
2. Safe Mode: Strongly decide karein ki aap lifetime saath rehna chahte hain
Agar aap log genuinely lifetime saath rehna chahte hain, toh sabse pehle safe jagah par shift hona best hota hai — jaha wahan aap easily 30 din ka residence proof bana sakte ho.
Agar family se threat ho toh:
- Protection application file karni pad sakti hai
- Lekin ye aapke expenses badha deti hai
- Jis ghar me aap rahenge, wo rent zyada bol sakta hai (kyunki police visit hoti hai)
- Advocate ki protection matter fee normally ₹30,000+ hoti hai
- Police kam se kam 1 visit karti hi karti hai
Agar threat nahi hai → bina protection ke aage badh sakte ho.
3. Delhi me minimum 30 din ka continuous residence — SMA ka backbone requirement
SMA ke under Delhi me court marriage ke liye:
Bride ya Groom me se kisi ek ka Delhi me minimum 30 din continuous stay zaroori hai.
Accepted proofs:
- Rent agreement + electricity/water bill
- Company accommodation letter
- Relative ke ghar reh rahe ho toh unka ID + unka affidavit
- Genuine stay proof ho, coloured, readable ho
Note: Kuch SDM Delhi ka “koee govt-based stay proof” prefer karte hain.
4. Documents list — Complete & practical
A. Parties ke documents:
- Aadhaar / Voter ID / Passport / DL
- Age proof: 10th certificate / birth certificate / passport
- Permanent address proof (native state ka)
- Delhi residence proof (30 days)
- Passport size photos (4–6)
- Divorce decree / death certificate (agar applicable)
B. Witnesses (3 required in Delhi):
- Aadhaar / Voter ID / DL
- Preferably Delhi address
- Witness ko aap personally jaante ho
- Date pe present rehne wale ho
5. Email aur Mobile Number — EDMISTRICT online form ke liye mandatory
e-District Delhi me SMA ka form fill karte waqt:
- Active mobile number (OTP aati hai)
- Valid email ID (appointment, acknowledgement milta hai)
Dono working hone chahiye warna application reject ho sakti hai.
6. Documents scan karna sabse challenging step hota hai (200 KB limit)
Maximum upload size: 200 KB per document
Problem:
- 2-page affidavit 200 KB me clear lana mushkil
- Mobile scan blurry ho jata hai
Professional scanning best option hota hai.
Agar mobile se hi karna hai toh ek trick:
- Har page ki clear photo lo
- Windows Photos app me “Resize” → 50–60 KB per image
- Adobe Scan se PDF merge kar lo
- File final size comfortable 150–200 KB aata hai
7. SDM office se affidavit format aur list ek baar zaroor le lo
Har SDM office ki apni formatting & demands hoti hain.
Pehle visit me:
- Notice form
- Affidavit format
- Required documents list
- Witness instructions
le aao, taaki baad me file reject na ho.
8. e-District Delhi par application fill karein — IMPORTANT TIP: Payment online hi karein
Online portal par:
- Form fill
- Documents upload
- Payment online (Card/GPay/NetBanking)
Sabse important baat:
Agar aap online payment kar dete ho, application “legally filed” ho jati hai. SDM bina valid written reason ke reject nahi kar sakta.
Agar window par payment karoge:
- File “accepted” nahi hoti
- Staff bina decide kiye wapas kar deta hai
- No accountability
Isliye: Always pay online.
9. SMA procedure me minimum 2 baar SDM appearance mandatory hota hai
(1) First appearance — Notice of Intended Marriage file karna
- Dono parties physically present
- Witness is din required nahi
- Documents check
- Notice accept hota hai
- 30 din ke liye notice board par display
Ye first impression hota hai SDM ka.
(2) Second appearance — Marriage solemnization
30 din ke baad:
- Dono parties + 3 witnesses
- Witness verification hoti hai
- Declaration form sign
- Simple ceremony (SMA declaration)
- Register me signatures
- Certificate issue
10. Witness se poochhe jaane wale common questions (SDM aazmaane ke liye)
Witness ko mentally prepare karna chahiye.
SDM puchh sakta hai:
- Aap ladke/ladki ko kaise jaante ho?
- Kab se jaante ho?
- Kya aap unke ghar walon se mile ho?
- Aap voluntarily aaye ho?
- Aapko koi payment di gayi?
- Aapka ID proof original?
- Address, mobile number kya hai?
Witness genuine lagna chahiye — paise dekar laaye gaye witness reject ho sakte hain.
11. Mentally assume karein ki SDM aapki file reject kar sakta hai — isi se confidence aata hai
Aapka golden point:
Agar client SDM ko final authority maan lega, to wo pareshaan ho sakta hai.
Lekin law ke hisaab se:
SDM final authority nahi hota — Appeal District Court me jati hai.
Isliye:
- Documents crystal clear rakho
- Steps strictly follow karo
- Har acknowledgement save karo
- Witness solid rakho
- Affidavit correct format me ho
