Rules for Filing a Bail Application in the Delhi High Court

Before filing a bail application before the Hon’ble Delhi High Court, ensure that the petition complies with the following procedural and documentation requirements. Any deficiency may result in objections, delay in listing, or return of papers.

  1. State must be served. Service of notice should be made to the State through its official email ID by sending a soft copy of the petition and annexures. Mention in the petition that service has been effected.
  2. Clearly mention in the heading of the petition the date from which the Petitioner is in Judicial Custody.
  3. The Petition, Applications, Orders, Annexures, and Power of Attorney must be properly signed and stamped.
  4. Certified copies of all annexures and orders must be filed. If certified copies are not available, an application showing inability and urgency to consider the matter without certified copies must be filed.
  5. An opening sheet must be affixed and placed before the main petition or appeal.
  6. The Affidavit should be properly attested and must mention the age of the deponent.
  7. Attach a copy of the FIR. If the FIR is in Hindi, a typed English version must also be filed.
  8. A List of Dates and Synopsis must accompany the petition. If the petition/appeal is barred by time, reasons for delay should be stated.
  9. The Power of Attorney must be attested by the Jail Authority and stamped with the Welfare Stamp, the amount of which may vary from time to time (commonly ₹10/-).
  10. Annexures should be certified as true copies and filed on foolscap paper.
  11. If uncertified copies are filed, add a note of urgency explaining the reason for filing without certified copies.
  12. The petition must clearly state how it is maintainable.
  13. A Memo of Parties must be duly filed and signed.
  14. A Statement of Non-filing should accompany the petition, confirming that no similar petition for the same relief has been filed earlier.
  15. The petition must be properly bookmarked and paginated as per the index filed.
  16. A fair typed copy of any dim or handwritten annexure should be provided.
  17. English translations of vernacular documents must be filed, or the translated vernacular version should be annexed.
  18. The Counsel must certify that all translations, including that of the FIR, are true and correct.
  19. Maintain a margin of 4 centimeters on the left side of every page of the petition and annexures.
  20. The ID proof of the Petitioner, along with a recent coloured photograph, must be annexed.
  21. The Prayer Clause should clearly mention the FIR number, offences invoked, and police station concerned.
  22. The Listing Proforma, duly filled in, must be filed in both sets.
